About the NHVR

The National Heavy Vehicle Regulator (NHVR) commenced operations in 2013 as an independent body responsible for regulating all vehicles in Australia over 4.5 tonnes gross vehicle mass. Located in Brisbane, the NHVR minimises the compliance burden on the heavy vehicle transport industry, reduces duplication and inconsistencies across state and territory borders, and ultimately for the heavy vehicle business with government in Australia.

About the role

There is one role available and work location will be dependant on the successful applicant. (Adelaide, SA or Launceston, TAS)

This position supports the delivery of Regulatory and Legal Services objectives through the provision of quality prosecution services aimed at improving safety and regulatory compliance outcomes for the heavy vehicle industry.

The successful candidate will enjoy working in a challenging, fast paced environment and will be proactive, professional with demonstrated experience in maintaining a high level of confidentiality.

Working as part of a small team representing the NHVR in proceedings for offences against the Heavy Vehicle National Law, you will work closely with investigators, on road compliance and enforcement officers, and partner agencies and legal representatives to ensure the timely and efficient conduct of proceedings.

Key responsibilities and accountabilities

  • Preparing for matters listed in Courts of Summary Jurisdiction of various States and Territories of Australia, having due regard to all evidentiary requirements.  Appear in the Courts of Summary jurisdiction and conduct summary and District Court hearings, as required.
  • Research, analyse and make determinations on briefs of evidence and court elected expiation notices relating to breaches of the Heavy Vehicle National Law, while ensuring that legislative and policy considerations are appropriately applied.
  • Assess the sufficiency of evidence contained in briefs and identify the correct charges to be preferred in accordance with the Prosecution Policy of the NHVR.
  •  Draft documents, such as informations and summonses in relation to breaches of the Heavy Vehicle National Law and Regulations, while ensuring that legislative and policy considerations are applied.
  • Develop and maintain an active working knowledge of legal constraints and precedents relating to matters of law which could influence proceedings for breaches of the Heavy Vehicle National Law and Regulations.
  • Work effectively, either individually or as part of a team, with an emphasis on meeting deadlines within quality, cost and time constraints.
  • Provide sound options or recommendations to internal and external stakeholders, and assist in the development of business practices, policy and legislation.
  • Work as a member of a small team to present a consistent interpretation and application of the Heavy Vehicle National Law.
  • Draft complex correspondence, reports, briefing notes and submissions in accordance with agency standards.
  • Consult, liaise and maintain effective relationships with internal and external stakeholders.
  • Compliance with the requirements of the Australian Solicitors Conduct Rules.

Qualifications and Experience

Essential to the Role

  • Hold a Degree in Law and be admitted or be eligible to be admitted as a Legal Practitioner in the Supreme Court of a State or Territory of Australia.
  • The incumbent is expected to handle confidential and sensitive material and adhere to all relevant guidelines in relation to confidentiality, disclosure of information, impartiality and conflict of interest.
  • Some out of hours work and intrastate and interstate travel necessitating overnight absences will be required.
  • A current driver's licence is essential.

Highly Desirable:

  •  Previous experience in a State, Commonwealth or regulatory prosecuting office.
  • Experience in the conduct of criminal proceedings relating to breaches of a Work, Health and Safety Act, or other Act requiring compliance with a primary duty to ensure safety.

Additionally, the successful candidate will be required to undergo criminal history and background checks. All NHVR employees are required to comply with legislative and regulatory requirements and organisational policies and management standards.
