About the business and the role

Madgwicks Lawyers is a Melbourne based business law firm established in 1971.  Our main practice areas are commercial litigation, insolvency and reconstruction, commercial property, corporate and commercial law, franchising, funds management and superannuation, information technology, intellectual property, tax, workplace relations, wills and estates.

We seek a Commercial Lawyer with two years' plus proven PAE with some exposure and interest in Technology and IP.

The Commercial team has a broad commercial practice which includes Technology, Media, and Telecommunications. We work closely with a variety of technology clients including app developers, fintechs and cloud vendors supplying technology related products and services in Australia and overseas.  We also specialise in areas including privacy compliance, cyber security and intellectual property (IP) related advisory work.

We have significant expertise in the Technology sector with Technology Media and Telecommunications (TMT) Partner Dudley Kneller listed in Doyles' Guide as a Recommended Technology, Media & Telecommunications Lawyer in Victoria for the past four years and Madgwicks as a Recommended TMT Law Firm in Victoria in 2018 and 2016. Dudley is the only Australian lawyer appointed to Lexing, an international network of lawyers that specialise in digital and emerging technology law, and is a technical expert to Lexis Nexis' Regulatory Compliance Team.

Job tasks and responsibilities

The successful candidate will be a dynamic self-starter and in return we offer a collaborative and supportive environment which focuses on great commercial outcomes for our clients and a genuine focus on developing our people.

The position will also provide exposure and the opportunity to work across other areas of the corporate commercial team.

Main accountabilities will include:

  • Assist Partners and senior colleagues within a range of advisory technology/ telecommunications and IP and commercial matters including areas such as (but not limited to):
    • Technology supply and procurement agreement;
    • Technology and business process outsourcing/offshoring transactions;
    • Major system supply and procurement projects;
    • Technology licensing, development and support agreements;
    • Cyber security advice including breach response, policy development, training and incident management;
    • Additional regulatory advice including in relation to   data security, privacy and content regulation.
  • Perform IP related legal services (at level), including but not limited to:
    • Negotiate, draft, interpret and advise clients on IP related agreements;
    • Advise clients on various IP matters including copyright and trademarks; and
    • Liaising with our disputes team and external counsel on contentious technology/IP   matters.
  • Prepare and draft various commercial contracts, letters of advice, assist clients in complying with legislative and regulatory obligations, and attend and conduct client meetings and negotiations.

Experience

  • Two years' plus proven PQE/PAE in the areas of Technology/IP within a corporate/commercial environment.
  • Exposure to commercial business law issues.
  • Holder of a current Australian Practising Certificate.
