In House Litigation Counsel

Our Client is a leading corporate in the Energy/ Utilities sector.
They are currently looking for an experienced litigator to join their high performance legal team to manage their litigation and WHS Investigations work as well as assisting with corporate and commercial work as required.

This position will involve working closely with the procurement, operations and health and safety teams on disputes involving services agreements, procurement contracts, construction and WHS investigation.
The position will also involve assisting on various front end corporate activities around 20% of the time - including negotiating and drafting contracts, providing legal support to on disputes as well as working with external counsel and suppliers as required. 

The ideal candidate:
  • Will come from a Top or Mid tier law firm or an in house legal team in the Construction/ Property/ Energy/ Utilities space
  • Be a high energy, positive contributor to the workplace
  • Enjoy working collaboratively both within the legal team and across the business.
Key Accountabilities
  • Manage and advise on disputes, primarily arising out construction and services transactions and WHS / works, including manage relationships with witnesses and other internal stakeholders, co-ordinate document production and record management, and provide guidance on generic dispute / evidentiary issues such as legal professional privilege;
  • Liaise with key internal and external stakeholders (including key suppliers);
  • Successfully manage external counsel;
  • Provide commercial and regulatory advice specific to the industry including regulatory changes and corporate governance issues;
  • Provide legal advice in relation to WHS and works authorisations;
  • Work with and provide training for various internal commercial stakeholders, including procurement, operations and health and safety teams;
  • Negotiate and draft construction and services procurement documents, as well as settlement deeds (including assisting with the development and management of template documents), including working with and providing training for various internal commercial stakeholders; and
  • Demonstrated awareness of and commitment to:
  • Maintaining competency across broad ranging areas of legal risk in construction, operations and WHS; and
  • Prioritising competing deadlines imposed by various stakeholders in the delivery of advice.
Essential:
  • 4-9 years post qualification experience in construction and / or commercial litigation disputes (ideally in the construction and / or utilities sectors);
  • Australian based experience and knowledge of commercial construction contracting;
  • Commercial awareness and the ability to work effectively with internal clients;
  • Excellent negotiation and influencing skills and the proven ability to manage competing priorities across a diverse portfolio of matters;
  • Superior analytical, drafting and negotiation skills with good risk management awareness;
  • Ability to communicate complex legal and compliance-related concepts to a broad range of technical and non-technical staff;
  • Ability to maintain confidentiality of highly sensitive information, use discretion and make sound decisions.
Desirable:
  • Work Health and Safety Act;
  • Energy / Utilities sector experience (including renewable energy); and
  • Real property dispute experience (for example, lease revaluations, compulsory acquisition, land access rights).
