My client is a leading national law firm in the area of strata and community title law which specialises in the areas of insurance law, commercial dispute resolution, debt collection, building & construction, insolvency, corporate and commercial transactions/litigation, planning and property law.

The role
We are seeking a passionate and professional Intermediate to Senior Commercial Litigator to hit the ground running, confidently handling a range of quality work that includes stimulating Commercial Litigation & Insolvency matters.

Ideally, you will have at least 3 to 6 PAE with solid insolvency and commercial litigation experience, refined drafting skills and strong advocacy skills. It is essential that you are highly motivated, have an avid intellectual mind with a keen eye for detail. A candidate with a bankruptcy background will be highly regarded. 

The ideal candidate will have experience in some, but not necessarily all, of the following areas: 

• Running litigation in the Federal Court and Federal Circuit Court regarding disputed bankruptcy notices and creditor’s petitions;
• Running litigation in the Supreme Court regarding Corporations matters and property disputes;
• Drafting advice regarding equitable interests in Real Property including resulting trusts, constructive trusts, Cummins Trusts etc.;
• Pursuing recovery of antecedent transactions, including 139ZQ Notices;
• Advising trustees in relation to matters arising under the Bankruptcy Act;
• Pursuing preference payments on behalf of liquidators;
• Providing advice in relation to uncommercial transactions, unreasonable director related transactions and insolvent trading;
• Providing advice to liquidators of corporate trustees in liquidation;
• Exposure to matters involving s 79 Family Law Act claims; and
• Managing own cases and appearing frequently in various court proceedings.
