Our client is one of Australia's oldest and largest energy suppliers and is currently seeking an additional Legal Counsel to be their go-to, in-house lawyer for all litigation matters, as well as assist with the wider front-end, commercial work.

Description

Based in Sydney CBD, you will be part of the Legal & Company Secretary division of the company, reporting into the Group Counsel (Finance).

You will provide legal advice and guidance to facilitate the resolution of external disputes across the business from procurement and operations to the health and safety teams, to include assisting with the management of certain safety and other investigations. For the remainder of the role, you will assist with the broader, front-end commerical work and corporate activities, to include negotiating and drafting construction, network services and other procurement contracts.

Key duties include:

  • Managing and advising on disputes, primarily arising out construction and network services transactions and WHS - this includes managing relationships with witnesses and other internal stakeholders, coordinating document production and record management and providing guidance on generic dispute/evidentiary issues, such as legal professional privilege;
  • Assisting with negotiating and drafting construction and network services procurement documents, as well as settlement deeds (including assisting with the development and management of template documents), including working with and providing training for various internal commercial stakeholders;
  • Assisting with safety and other regulatory investigations;
  • Successfully managing external counsel;
  • Providing commercial and regulatory advice specific to the industry including regulatory changes and corporate governance issues;
  • Providing legal advice in relation to WHS and electrical works authorisations; and
  • Working with and providing training for various internal commercial stakeholders, including procurement, operations and health and safety teams.

Profile

THE SUCCESSFUL CANDIDATE:

Essential:

  • You must have at least 4+ years PQE in either construction, WHS/employment and/or general commercial litigation disputes (ideally in the construction or utilities sectors);
  • An interest in developing skills in front-end construction contract negotiation;
  • Commercial awareness and the ability to work effectively with internal clients;
  • Excellent negotiation and influencing skills and the proven ability to manage competing priorities across a diverse portfolio of matters;
  • Superior analytical, drafting and negotiation skills with good risk management awareness;
  • Ability to communicate complex legal and compliance-related concepts to a broad range of technical and non-technical staff; and
  • Ability to maintain confidentiality of highly sensitive information, use discretion and make sound decisions.

Desirable:

  • Local, Australian-based experience and knowledge of commercial construction contracting;
  • Work Health and Safety Act (or equivalent legislation in other jurisdictions) and similar regulatory experience;
  • Energy/Utilities sector experience (including renewable energy); and
  • Real property dispute experience (for example, lease revaluations, compulsory acquisition, land access rights).
