President, Mental Health Review Tribunal

Location: Gladesville

Full Time, Term Appointment

 

The Minister for Mental Health, invites expressions of interest from qualified persons for appointment as the full time President of the Mental Health Review Tribunal under the Mental Health Act 2007 for a term of up to 7 years.

 

The Mental Health Review Tribunal is a specialist quasi-judicial body constituted under the Mental Health Act 2007. It has a wide range of powers that enable it to conduct mental health inquiries, make and review orders, and to hear some appeals, about the treatment and care of people with a mental illness under the Mental Health Act 2007. The Tribunal also has responsibility for functions under the Mental Health (Forensic Provisions) Act 1990 related to the care and treatment of forensic and correctional patients.

 

The Minister is seeking to appoint a candidate who preferably:

 

  • has applied experience or professional expertise with mental health legislation and policy and issues relating to forensic patients and persons with a mental illness
  • exemplary communication and interpersonal skills to lead and communicate with a range of stakeholders including members of the Tribunal, Ministers of Parliament, the public and public service agencies
  • displays the highest standards of judgment and integrity and
  • has proven ability to provide leadership and oversee the operations of a multi-disciplinary body exercising quasi-judicial powers.

 

Eligibility Requirements

 

The Mental Health Act 2007 sets the following qualifications for a person to be eligible to be appointed as a President of the Tribunal:

  1. hold or have held office as a judge of the Supreme Court or the District Court, or as a judge of an equivalent court of another State or a Territory, or
  2. hold or have held office as a judge of the Federal Court or the High Court, or
  3. are qualified to be appointed as a judge referred to in this clause

 

To be eligible for appointment as a judge referred to in (c) above a person must be an Australian Lawyer with at least 7 years standing.

 

This is a full time Presidential Appointment. Remuneration for this position is $387,930 per annum as determined by the Statutory and Other Officers Remuneration Tribunal, subject to an annual increase from 1 July 2018.
