Office of the Health Ombudsman, Brisbane

  • Flexible full-time contract for 3 years with possible 2 years extension
  • $157,840 - $172,743 per annum

 

The Executive Director, Legal Services (who will be appointed to as Director of Proceedings) is a member of the Office of the Health Ombudsman’s Executive Management Team and oversees the legal and prosecutorial functions of the organisation. The position forms part of the Office of the Health Ombudsman, but may be required (as established by the Health Ombudsman Act 2013) to act independently in relation to certain matters.

 

The position is appointed by the Health Ombudsman and is an employee of the Office of the Health Ombudsman.  The position makes independent decisions about certain matters referred to them. The position is not subject to the direction of the Health Ombudsman or anyone else about a decision whether or not to refer a matter to QCAT or about the prosecution of a matter before QCAT.

 

Qualifications/professional registration/other requirements

The appointee must be a lawyer, barrister or otherwise appropriately qualified to practise on behalf of the Office of the Health Ombudsman in a court or tribunal setting.

 

Responsibilities of the role

The primary role of the Executive Director, Assessment and Resolution is to:

  • Act as the head of the Division and manage the team of legal officers in the Division.
  • Perform the functions of the ‘Director of Proceedings’ as prescribed by the Health Ombudsman Act 2013.
  • Provide strategic advice to the Ombudsman and take an active role in the implementation of the office’s strategic direction through leading and managing the legal, prosecutorial and legislative functions of the organisation.
  • Provide instructions and direction to external legal service providers regarding the management of major legal issues affecting the Office of the Health Ombudsman.
  • Represent and act as an advocate for the Health Ombudsman and Office of the Health Ombudsman in major consultation and negotiation initiatives which have a significant impact on the operations of Office of the Health Ombudsman or Government.
  • Lead the review of cases and make an independent decision on whether complaints referred to the Office of the Health Ombudsman and other matters should be referred to QCAT.
  • Lead the prosecution of the complaints and other matters that are referred to QCAT.  This includes oversight of staff responsible for drafting of complaints/motions, presenting evidence and prosecuting matters before QCAT, and may involve actually undertaking these tasks in person subject to the severity of a matter.
  • Participate in the conduct quality assurance reviews of the OHO and contribute to a culture of continuous improvement and business excellence through sharing ideas for improvements in relevant functional areas.
